1. Introduction

Kobbware (“Kobbware”, “we”, “us” or “our”) provides IT support and computer repair, data recovery, gadget and computer accessory sales, and tech training through Kobbware Academy. Your trust matters to us, and so does the information you share with us. This Privacy Policy explains what personal data we collect, why we collect it, how we protect it, who we share it with, and the rights you have over it.

By using our website, visiting our stores, buying our products, using our IT support services or enrolling in our training, you acknowledge that you have read this Policy. Where the law requires your consent for something we do, we will ask for it separately and you can withdraw it at any time.

The data controller for the personal data described in this Policy is:

3. The Laws That Govern This Policy

We handle personal data in accordance with:

• the Nigeria Data Protection Act 2023 (“NDPA”) and the Nigeria Data Protection Commission’s General Application and Implementation Directive (GAID) 2025;

• the Constitution of the Federal Republic of Nigeria 1999 (as amended), which protects the privacy of citizens;

• the Cybercrimes (Prohibition, Prevention, etc.) Act 2015 (as amended), including its rules on data retention and the protection of computer data;

• the Federal Competition and Consumer Protection Act 2018, which protects consumers from unfair and deceptive practices;

• where it applies to you, the EU General Data Protection Regulation (GDPR) and the UK GDPR, if you are in the European Economic Area or the United Kingdom when you use our services or we offer goods or services to you there; and

• other privacy laws that apply to you where you live, such as the California Consumer Privacy Act where applicable.

Where these laws differ, we apply the standard that gives you the stronger protection.

4. What Personal Data We Collect

The data we collect depends on how you deal with us.

• Website visitor: IP address, device type, browser, pages visited, referral source, approximate location and cookie identifiers.

• Enquirer (contact form, call, WhatsApp, email): Name, phone number, email address, the content of your message, and any files or screenshots you send.

• IT support or repair customer: Contact and billing details, device make, model and serial number, fault description, diagnostic and test results, repair history, remote-support session details, and any account or device passwords you choose to give us for the repair.

• Data recovery customer: All of the above, plus access to the storage device and the files on it during the recovery process.

• Shop customer: Name, delivery address, phone number, email, order history, payment confirmation details (not full card numbers), and warranty and return records.

• Academy student: Name, phone number, email, date of birth, address, education or experience background, emergency contact, attendance and assessment records, certificates issued, and photographs or recordings of class activity where you have agreed.

• Parent or guardian of a student under 18: Your name and contact details, your relationship to the student, and your consent record.

• Business or corporate client: Company details, contact persons, contract and invoicing details, and information about the systems we support.

• Visitor to our premises: Images captured by CCTV and visitor log details.

• Job applicant or partner: CV and application details, references and contact information.

Sensitive data. We do not ask for sensitive personal data (such as health, religion, political opinion, biometric data or ethnic origin). However, customer devices can contain sensitive information. Please see section 7 on how we treat the data on your devices.

5. How We Collect Your Data

• Directly from you, when you fill in a form, place an order, enrol, call us, message us or walk into our store.

• Automatically, through cookies and similar technologies on our website.

• From your device, when you hand it in for repair, diagnosis or data recovery, or give us remote access.

• From third parties, such as payment processors who confirm your payment, delivery partners, and public sources, where this is lawful.

6. Why We Use Your Data and Our Legal Basis

Under the NDPA we must have a lawful basis for every use of your personal data. This table shows ours.

• Providing IT support, repairs and data recovery (diagnosing faults, giving quotes, repairing and testing devices, recovering files). Lawful basis: performance of a contract with you, or steps you ask us to take before a contract.

• Selling and delivering products (processing orders, arranging delivery, issuing receipts, handling warranty claims and returns). Lawful basis: performance of a contract.

• Running Kobbware Academy (enrolment, class administration, assessment, certificates). Lawful basis: performance of a contract, and consent for photos and recordings.

• Taking payment and preventing fraud (verifying payments, detecting suspicious orders, managing chargebacks). Lawful basis: contract, and our legitimate interests in preventing fraud.

• Customer support and complaints (answering questions, resolving problems). Lawful basis: contract and legitimate interests.

• Legal and regulatory compliance (tax and accounting records, responding to lawful requests from authorities, anti-money-laundering checks). Lawful basis: legal obligation.

• Marketing (sending offers, updates and tips by email, SMS or WhatsApp). Lawful basis: consent, or our legitimate interests where the law allows, always with an easy opt-out.

• Improving our website and services (analytics, surveys, testing new features). Lawful basis: legitimate interests, and consent for non-essential cookies.

• Securing our premises, systems and staff (CCTV, access logs, network security). Lawful basis: legitimate interests and legal obligation.

Where we rely on legitimate interests, we weigh them against your rights and freedoms and we do not use your data in ways that override them.

7. The Data on Your Devices

When you bring us a laptop, phone, drive or other device, you are trusting us with everything on it. We take that seriously.

• We access only what is needed to diagnose, repair, test or recover. We do not browse your personal files, photos, messages or accounts for any other reason.

• We do not copy, keep, share or sell the contents of your device. Where recovery requires a temporary copy, we hold it only for the job, protect it, and securely delete it after the job is complete and you have confirmed receipt, usually within 14 days.

• All our technicians and trainers are bound by confidentiality obligations, and we limit device access to the staff working on your job.

• Where we need your device password or remote access, we ask you first, use it only for the agreed work, and ask you to change it afterwards.

• If we find content we are legally required to report, such as child sexual abuse material, we will report it to the relevant authorities as the law requires. This is the only circumstance in which we would disclose device contents without your instruction.

We strongly recommend that you back up your files before handing in any device, and that you remove any information you do not want us to be able to see.

8. Marketing Communications

We will send you marketing only where you have agreed or where the law allows. Every marketing message includes a clear way to opt out. You can also opt out at any time by contacting us at support@kobbware.com or by replying STOP to an SMS or WhatsApp message. Opting out of marketing does not stop service messages, such as repair updates, order confirmations and class notices.

9. Who We Share Your Data With

We do not sell your personal data. We share it only as needed, with:

• Payment processors and banks, to take payment and prevent fraud.

• Delivery and logistics partners, so your order reaches you.

• Technology providers, such as website hosting, cloud storage, email, SMS and messaging services, customer management tools and analytics providers, who process data on our instructions.

• Suppliers and manufacturers, where needed to process a warranty claim or order a part.

• Professional advisers, such as lawyers, auditors and insurers, under duties of confidentiality.

• Regulators, courts and law enforcement, where the law requires or a valid legal process compels us.

• A buyer or successor, if Kobbware is ever sold or restructured, on the basis that your data stays protected under this Policy.

Every third party that processes personal data for us is bound by a written agreement that requires them to protect it, use it only for our purposes and handle it in line with the NDPA.

10. Transfers Outside Nigeria

Some of our service providers, such as cloud hosting and email platforms, store or process data outside Nigeria. Where we transfer personal data abroad, we do so only where:

• the destination country, or the recipient, provides an adequate level of data protection as recognised under the NDPA; or

• we have put appropriate safeguards in place, such as binding contractual clauses, or another lawful transfer mechanism that the NDPA and the Nigeria Data Protection Commission (“NDPC”) allow; or

• you have given informed consent, or another legal exception applies.

For visitors in the EEA or UK, we use recognised safeguards such as standard contractual clauses where required.

11. How Long We Keep Your Data

We keep personal data only as long as we need it for the purposes in this Policy, and to meet legal duties.

• Contents of devices and recovered data: Deleted within 14 days of job completion and your confirmation.

• Repair records, warranty and order records: 6 years from the transaction, to cover warranty, tax and legal claims.

• Invoices and accounting records: At least 6 years, as tax and company laws require.

• Academy student records: 6 years after the course. Certificate verification records may be kept longer.

• Enquiries that do not become customers: 24 months.

• Marketing preferences: Until you opt out, plus a record of your opt-out.

• CCTV footage: Up to 90 days, unless needed for an investigation.

• Website analytics data: Up to 26 months.

• Job applications: 12 months.

When the retention period ends, we delete or anonymise the data securely.

12. How We Protect Your Data

We use technical and organisational measures that are appropriate to the risk, including:

• access controls and the principle of least privilege;

• encryption of data in transit, and of stored data where practical;

• secure, separate workstations for data recovery work;

• staff confidentiality agreements and regular privacy and security training;

• physical security and CCTV at our premises;

• regular backups and security updates; and

• vendor checks before we engage service providers.

No system is completely secure, and we cannot guarantee absolute security. If you believe your interaction with us is no longer safe, please tell us immediately.

13. Data Breaches

If a personal data breach is likely to put your rights and freedoms at risk, we will notify the NDPC within 72 hours of becoming aware of it, as the NDPA requires. If the breach is likely to result in a high risk to you, we will also tell you without undue delay, explaining what happened, what data was affected, what we are doing about it, and what you can do to protect yourself.

14. Your Rights

Subject to the NDPA and other applicable laws, you have the right to:

• Be informed about how we use your data, which this Policy does.

• Access a copy of the personal data we hold about you.

• Correct data that is inaccurate or incomplete.

• Delete your data, where it is no longer needed or you withdraw consent and no other lawful basis applies.

• Restrict how we use your data in certain circumstances.

• Object to processing based on our legitimate interests, and object at any time to direct marketing.

• Receive your data in a portable format and ask us to transmit it to another controller where the law gives you that right.

• Withdraw consent at any time, without affecting earlier lawful processing.

• Not be subject to purely automated decisions that significantly affect you. We do not make such decisions.

How to use your rights: Email our DPO at privacy@kobbware.com with your request. We may ask you to confirm your identity first, to protect your data from fraudulent requests. We respond within one month, and we may extend this where a request is complex, telling you why. We do not charge a fee, unless a request is clearly unfounded or excessive.

We may refuse a request where the law allows, for example where we must keep records to comply with a legal duty. If so, we will explain our reasons.

If you are in the EEA or UK, you also have the rights set out in the GDPR and UK GDPR, including the right to lodge a complaint with your local supervisory authority.

If you live in California, you have the right to know, delete and correct your personal information and to opt out of its sale or sharing. We do not sell or share personal information for cross-context behavioural advertising, and we do not discriminate against anyone who uses these rights.

15. Children

Our shop and website are not directed at children under 18, and we do not knowingly collect their personal data without the consent of a parent or guardian. Kobbware Academy may enrol students under 18 only with the written consent of a parent or guardian, who may review, correct or ask us to delete the student’s data. If you believe a child has given us personal data without permission, contact us and we will delete it promptly.

16. Payments

Payments on our website and in-store may be handled by licensed third-party payment processors. We do not store your full card number, expiry date or security code. Card data is entered on, and processed through, the payment processor’s secure systems, which are required to meet industry security standards such as PCI DSS. For bank transfers, we keep the transaction details needed for our accounting records.

17. Cookies and Similar Technologies

Our website uses cookies and similar tools to make the site work, remember your preferences, understand how visitors use it, and improve our services.

• Essential cookies: Keep the site secure and working, such as page loading, the shopping basket and form submission. Always on, because the site cannot work without them.

• Analytics cookies: Help us understand traffic and improve content. On only with your consent.

• Marketing cookies: Show relevant offers and measure advertising. On only with your consent.

18. CCTV at Our Premises

We operate CCTV at our Ikeja and Jos offices to protect customers, staff, devices and stock. Signs tell you where cameras are in use. Footage is accessed only by authorised staff and shared only where the law requires, or to investigate an incident.

19. Links to Other Websites

Our website may link to other websites, such as manufacturers, payment pages or social media. We do not control those websites and are not responsible for their privacy practices. Please read their policies before sharing data with them.

20. Changes to This Policy

We may update this Policy to reflect changes in our services or in the law. We will post the new version on this page with a new date, and where a change is significant, we will tell you directly. Your continued use of our services after the update means you accept the revised Policy, except where the law requires us to get your fresh consent.

Refund, Return and Waranty Policy

Kobbware Refund, Return and Warranty Policy

Effective date: 18 October 2026 Last updated: 18 October 2026

1. Our Promise

At Kobbware we repair devices, sell tested gadgets and computer accessories, and train people in tech skills. We want you to be happy with what you pay for. If something goes wrong, this Policy tells you plainly what you can expect: when you can return a product, when you can get a refund, what our warranties cover, and how to make a claim.

This Policy applies to purchases from Kobbware Smart Shop (online and in-store), IT support, repair and data recovery services, and Kobbware Academy training. It works together with our Terms and Conditions and Privacy Policy.

Your legal rights come first. Nothing in this Policy takes away any right you have under Nigerian law, including the Federal Competition and Consumer Protection Act 2018 and the rules on goods being of merchantable quality, fit for purpose and as described. If you are buying from outside Nigeria, the mandatory consumer rights of your own country also remain unaffected.

2. Quick Summary

• Product that is faulty or not as described: Report within 7 days of delivery or collection for a replacement or full refund. Warranty covers it after that.

• Sealed, unused product (change of mind): Return within 7 days for a refund, with return shipping at your cost.

• Opened or used product (change of mind): Not returnable, unless we agree to it case by case.

• Repair or IT support work: 30-day workmanship warranty on the repaired fault, and a refund of labour if we cannot fix it.

• Data recovery: You pay according to the result, as set out in section 6.

• Academy course: Your refund depends on how early you cancel, as set out in section 7.

3. Definitions

• “Product” means any gadget, laptop, phone, component, accessory or other item we sell.

• “Service” means IT support, diagnosis, repair, data recovery, installation, remote support and other work we do.

• “Academy” means Kobbware Academy training courses and workshops.

• “Business days” means Monday to Friday, excluding public holidays in Nigeria.

• “DOA” (dead on arrival) means a product that does not work, or has a defect, when you first receive it.

• “Proof of purchase” means your receipt, invoice, order number or payment confirmation.

4. Buying Products From Kobbware

4.1 Cancelling an order before it ships

You can cancel an order that has not been dispatched or collected, and we will refund you in full. Contact us as soon as possible by phone, WhatsApp or email. Once an order has been handed to a courier, treat it as a return under section 4.4.

4.2 Faulty, damaged or incorrect products

If a product arrives faulty, damaged, or different from what you ordered or what we described:

1. Check it on delivery or collection. Where possible, test your product while the delivery agent is present or before leaving our store.

2. Tell us within 7 days of delivery or collection. Contact us on +234 703 586 0857 or at support@kobbware.com with your proof of purchase and clear photos or a short video of the problem.

3. We will inspect it, usually within 3 business days of receiving the product or your evidence.

4. You choose the outcome where the fault is confirmed: a free repair, a replacement of the same or an equivalent product, or a full refund of the product price and the original delivery fee. If the exact product is out of stock, you can take an equivalent or a refund.

We pay for return shipping on confirmed DOA, damaged or wrongly supplied products.

4.3 Warranty on products

The warranty period for each product is stated on your invoice or receipt. Unless your invoice says something different, these apply from the date of purchase:

• New laptops, phones and tablets: 12 months [confirm]

• Tested or used laptops, phones and tablets: 3 months [confirm]

• RAM, SSDs and hard drives: 12 months for new, 3 months for used [confirm]

• Chargers, adapters and batteries: 3 months [confirm]

• Accessories (mice, keyboards, bags, cables, hubs): 30 days [confirm]

• Networking equipment: 6 months [confirm]

Where a manufacturer offers a longer warranty, we will help you to claim it. The warranty covers manufacturing and hardware defects that appear under normal use. During the warranty, we will repair or replace the product at no cost. If we cannot repair or replace it within a reasonable time, you may choose a refund of the price paid, reduced fairly for use over time where the law allows.

The warranty does not cover:

• physical damage, such as drops, cracked screens, bent ports or broken hinges;

• liquid damage or exposure to excessive dust or heat;

• damage from power surges, unstable electricity, wrong chargers or voltage faults;

• damage from repairs, opening or modification by anyone other than Kobbware;

• software faults, viruses, malware, corrupted systems or data loss that is not caused by a hardware defect;

• normal wear and tear, including cosmetic scratches, keyboard wear and battery capacity decline over time;

• products with removed or tampered warranty seals or serial numbers; and

• loss, theft or misuse.

4.4 Change of mind returns

We give you a fair chance to change your mind on sealed products.

• You can return a product you do not want within 7 days of delivery or collection.

• The product must be unopened, unused, in its original sealed packaging, with all accessories and your proof of purchase.

• You pay for return shipping, unless the product was faulty or sent in error.

• We refund the product price once we receive and check the returned item. Original delivery charges are not refunded for change-of-mind returns.

What we cannot take back for change of mind:

• opened, activated, registered or used laptops, phones, tablets and storage devices, because they may hold personal data and cannot be resold as new;

• items fitted or installed at your request (for example, an SSD or RAM we installed);

• software, licence keys, gift cards, vouchers and downloadable products once delivered;

• items made, ordered or configured specially for you, including special-order and pre-order items once we have paid our supplier; and

• items sold as “final sale”, “clearance” or “as is” with the condition clearly disclosed before you bought. These remain covered by your legal rights if they have a fault we did not tell you about.

4.5 Used and refurbished products

We clearly describe tested, refurbished and used products, including their condition and any cosmetic marks. A used product is not faulty just because it shows the wear we described. You still have the same rights for faults that we did not disclose.

4.6 Delivery problems

If your order does not arrive, arrives late beyond the delivery time we gave you, or arrives with damaged packaging, contact us within 48 hours of the expected or actual delivery time. We will trace the delivery, and either redeliver or refund you in full. Please inspect packages before signing, and note any damage with the delivery agent.

5. IT Support and Repair Services

5.1 Diagnosis and quotes

We diagnose your device and give you a clear quote before we begin any repair. You decide whether to go ahead. A diagnostic fee of [amount, or “no charge”] may apply. If you approve the repair, we [credit the fee against the repair cost]. If you decline, you pay only the diagnostic fee, which is non-refundable because it covers technician time.

5.2 Deposits and parts

For repairs that need parts to be ordered, we may ask for a deposit, usually the cost of the parts. Once we have bought a part for your job, the cost of that part is non-refundable, because we cannot return it to the supplier. If the part is a standard stock item that we can use elsewhere, we will refund the deposit less any reasonable cost we incurred.

5.3 Workmanship warranty

We stand behind our repairs. Every repair has a 30-day workmanship warranty that covers the specific fault we repaired. If the same fault returns within 30 days, we will fix it again at no extra labour charge.

The warranty does not cover new or unrelated faults, damage after collection, liquid or physical damage, power surge damage, software issues you cause, or devices that someone else has opened or repaired after us. Parts we supply carry the warranty in section 4.3.

5.4 If we cannot fix your device

If we cannot repair your device, or cannot fix the fault you hired us to fix, you do not pay for labour on the failed repair. You pay only the diagnostic fee, and for any parts you approved that we have already bought and that cannot be returned. We will also give you honest advice on whether replacement is a better option, and show you tested alternatives in our Smart Shop if you wish.

5.5 Dissatisfied with a repair

Tell us within 7 days of collecting your device. We will inspect it and, if the repair is faulty, fix it free of charge. If we cannot put it right within a reasonable time, we will refund the labour you paid for that repair.

5.6 Pre-existing conditions and liquid-damaged devices

Some devices, especially those with liquid damage, corrosion, failing drives or earlier unsuccessful repairs, can develop new faults during or after repair, because of the condition they were already in. We will explain these risks in the quote. We are not liable for faults that were already present, or that arise from the existing condition of the device, provided we have told you about the risk and carried out the work with reasonable skill and care.

5.7 Uncollected devices

Please collect your device promptly. We will contact you when it is ready, and again if you do not collect it. If a device is not collected within 30 days of our notice, we may charge a reasonable storage fee of [amount] per week. If it is still uncollected after 90 days and we have sent you at least two written notices (by SMS, WhatsApp or email) to your last known contact details, we may sell or dispose of the device to recover our unpaid charges, to the extent the law allows. We will return any surplus from a sale to you. Before disposal, we will securely wipe any personal data.

6. Data Recovery

Data recovery is different from other repairs, because success depends on the condition of the drive and nobody can promise a result before examining it.

• Evaluation. We evaluate your drive and tell you what is likely to be recoverable, and what it will cost. An evaluation fee of [amount, or “no charge”] may apply and is non-refundable.

• Pay for results. You pay the recovery fee only for the data we successfully recover. [If we recover nothing, you do not pay the recovery fee beyond the evaluation fee.] You will see a list of recovered files before you pay.

• No guarantee. We cannot guarantee that all data, or any specific file, can be recovered, or that recovered files will be complete and usable.

• Confirmation. Please check your recovered files promptly. Once you confirm that you have received them, we securely delete our copies under our Privacy Policy.

• Do not keep using a failing drive. Continued use can cause permanent loss. We are not responsible for loss that happened before the drive reached us.

7. Kobbware Academy

7.1 Before the course starts

• 7 or more days before the start date: Full refund of tuition, less any non-refundable registration or admin fee of.

• 3 to 6 days before the start date: 70% of tuition refunded.

• Less than 3 days before the start date: You may transfer once to a later cohort at no charge, but no cash refund is given.

7.2 After the course starts

After the first session, tuition is non-refundable, because places are limited and we plan materials, equipment and instructors around you. If something serious prevents you from continuing, such as illness or a family emergency, tell us in writing. We will consider a transfer to a later cohort or a partial credit, case by case.

7.3 If we cancel or change the course

If we cancel a course or cannot offer you a place, you can choose a full refund of what you paid or a transfer to another cohort at no extra cost. If we change the schedule or venue, and the change does not suit you, you can ask for a refund of tuition for sessions you have not attended.

7.4 Instalments, materials and certificates

If you pay by instalment, you remain responsible for unpaid instalments for any period you attended. Learning materials and tools you have used, and certificates already issued, are not refundable. We do not guarantee employment, income or any particular outcome from a course.

8. Service Plans and Managed IT Support

If you have a recurring IT support plan with us, the terms in your agreement apply. Unless your agreement says differently, you may cancel with 30 days’ written notice. We will refund any fees paid for periods after the cancellation date, calculated daily, less any amounts you owe us.

9. How to Claim a Return, Refund or Warranty Repair

1. Contact us. Phone or WhatsApp +234 703 586 0857, email support@kobbware.com, or visit our Ikeja or Jos office. Give your name, order or invoice number, and a description of the problem.

2. Send proof. Include clear photos or a short video where relevant.

3. Return the item, if we ask you to. Pack it securely, with all accessories, and use a tracked courier or bring it in person. Keep your delivery receipt.

4. We inspect it and tell you the outcome, usually within 3 business days of receiving it.

5. We resolve it by repair, replacement or refund, as this Policy provides.

We may refuse a claim that is not covered by this Policy or the law, and we will explain why.

10. How and When We Refund You

• We refund to the original payment method wherever possible. For bank transfer payments, we refund to the account that made the payment, or another account that you verify in writing.

• Approved refunds are processed within 7 business days. Your bank or payment provider may take additional time to show the money.

• If you were charged twice, or your payment failed but you were debited, tell us with your transaction details. We will investigate and reverse valid duplicates promptly.

• If you were given a discount or promotion, the refund is for the amount you actually paid.

• Please contact us before opening a chargeback or payment dispute with your bank. We can usually resolve things faster, and we will cooperate fully with any bank enquiry.

11. Items We Cannot Refund

• Services already delivered with reasonable skill and care, such as completed diagnosis, installations, and repairs that fix the agreed fault.

• Parts ordered specially for your job.

• Gift cards, vouchers, software licences and digital products after delivery.

• Products damaged by misuse, accident, liquid or power surges after delivery.

• Items returned after the return period, or without their original packaging and accessories, unless covered by warranty or the law.

12. Complaints and Escalation

If you are not satisfied with how we handled your claim, write to us at support@kobbware.com, marking your message “Complaint”. A senior manager will review it and respond within 7 business days. You can also contact the Federal Competition and Consumer Protection Commission (FCCPC) or the Lagos State Consumer Protection Agency at any time, and nothing in this Policy limits that right.

13. Changes to This Policy

We may update this Policy from time to time. The version in force on the date you bought the product or service applies to your purchase.

• “Device” means any computer, phone, tablet, storage drive or other equipment you give us or let us access.

• “Contract” means the agreement formed between you and us under section 5.

3. Who Can Use Our Services

You must be at least 18 years old and legally able to make a binding contract to buy from us or to use our Services. A person under 18 may enrol in the Academy only with the written consent of a parent or guardian, who accepts these Terms on the student’s behalf and is responsible for fees. If you act for a business, you confirm that you have authority to bind it.

4. Using Our Website

You agree to use our website lawfully and fairly. You must not:

• break any Nigerian or applicable international law, including the Cybercrimes (Prohibition, Prevention, etc.) Act 2015 (as amended);

• try to gain unauthorised access to our systems, accounts or data, or interfere with the website’s operation, for example through malware, scraping or denial-of-service attacks;

• submit false, misleading or fraudulent information or orders, or use stolen payment details;

• copy, resell or exploit our content for commercial purposes without our written consent; or

• use the website to send spam or harmful, defamatory or unlawful material.

We work to keep the website accurate and available, but we do not promise it will be free of errors, interruptions or delays. We may update, suspend or remove any part of it at any time.

5. Buying Products From Us

5.1 How a contract is formed

Our website and price lists are an invitation to make an offer, not an offer to sell. When you place an order, you make an offer to buy. A contract is formed only when we confirm your order by sending you a confirmation (by email, SMS or WhatsApp), or when we hand over the Product against payment in-store.

5.2 Prices and payment

• Prices are in Nigerian Naira (₦) unless we state otherwise, and include [or exclude: confirm] Value Added Tax and any other applicable tax. Delivery charges are shown before you pay.

• Payment is due when you order, unless we agree different terms in writing. We accept the payment methods shown at checkout, including bank transfer and card payments through licensed payment processors.

• We reserve the right to correct pricing or description errors. If a Product was listed at an obviously wrong price, we may cancel the order and refund you in full, before shipping.

• For bank transfers, your order is reserved only once we confirm that the payment has been received.

5.3 Product information and availability

We describe our Products as accurately as we can, including condition (new, tested, used or refurbished), specifications and included accessories. Colours and images may differ slightly from the item. Stock levels change quickly. If a Product you ordered is unavailable, we will tell you promptly and offer a replacement, a wait, or a full refund.

5.4 Delivery and collection

• We deliver within Lagos, Jos and to other locations in Nigeria through courier partners. Delivery times we give are estimates, not guarantees, though we will make reasonable efforts to meet them.

• Risk in the Product passes to you when it is delivered to you or collected by you. Ownership passes to you only when we have received full payment.

• Please check your package on delivery and tell us at once about any damage or shortage.

• You must give us an accurate delivery address and be available to receive the order. We may charge extra for failed deliveries caused by incorrect details.

5.5 International orders

Where we agree to ship outside Nigeria, goods are sold on a delivered duty unpaid basis unless we agree otherwise in writing. You are responsible for import duties, customs charges, taxes and clearance in the destination country, and for making sure the goods can lawfully be imported. See section 16 on trade compliance.

5.6 Returns, warranty and refunds

Returns, refunds and warranties are set out in our Refund, Return and Warranty Policy, which forms part of the Contract.

6. IT Support, Repair and Data Recovery Services

6.1 Quotes and your approval

We diagnose your Device and give you a quote with the likely work, parts, cost and timeline. We will not start paid repair work until you approve the quote, by writing, by message or by paying a deposit. If we find a further problem during the work, we will ask for your approval before extra charges.

6.2 Your responsibilities

• Back up your data. You must back up your files before giving us any Device. Repair, testing and recovery can result in data loss, even when done with care. Unless the loss results from our negligence, we are not liable for loss of data, software or settings.

• Give accurate information about the Device, the fault and its history, including previous repairs, liquid exposure or damage.

• Remove or tell us about passwords, locks and accounts that could block our work (such as device locks and activation locks), and give us only the access you are comfortable with.

• Confirm ownership. You confirm that you own the Device, or are authorised by the owner to give it to us. We may ask for identification and may refuse work on a Device we reasonably suspect to be stolen, and report it to the authorities.

• Software licences. You are responsible for having valid licences for software on your Device. We do not install, activate or support pirated or cracked software.

6.3 Standard of work

We perform Services with reasonable skill and care, using qualified technicians. Our workmanship warranty and the treatment of failed repairs, liquid-damaged Devices, deposits, parts and uncollected Devices are set out in the Refund, Return and Warranty Policy.

6.4 Data and confidentiality

We treat everything on your Device as confidential. We access only what is needed for the work, we do not copy or keep your data except as needed for the job, and our staff are bound by confidentiality obligations. Our Privacy Policy explains this in detail. We will report material to the authorities only where the law requires us to, such as child sexual abuse material or evidence of a serious crime.

6.5 Data recovery

We cannot guarantee any particular data recovery result. Fees, evaluation and payment for results are set out in the Refund, Return and Warranty Policy. Where a drive is physically damaged, our attempts may reduce the chance of recovery by another provider. By proceeding, you accept this risk.

6.6 Remote support

If you grant us remote access, we will use it only for the agreed work and will end the session when finished. Please supervise the session. We are not responsible for anything that happens through remote access that you or another person initiates.

6.7 Replaced parts and Device condition

Parts that we replace become our property for disposal unless you ask us to return them when you approve the quote. We are not responsible for cosmetic wear, or for pre-existing damage that we noted or that was not reasonably discoverable. Where our quote warns of risks, such as with liquid-damaged Devices, we are not liable for the consequences of those risks if we have used reasonable skill and care.

6.8 Right to hold a Device

If you do not pay for Services you have approved and we have performed, we may keep the Device until you pay, as the law allows. Section 5.7 of the Refund, Return and Warranty Policy sets out what happens to Devices that are not collected.

7. Kobbware Academy

• Enrolment. Your place is confirmed when we accept your application and receive the fee or the first instalment.

• Fees and refunds. Fees, instalments, transfers and refunds are set out in the Refund, Return and Warranty Policy.

• Conduct. Students must behave respectfully, follow safety rules when handling equipment and tools, and look after Kobbware property. You are responsible for damage you cause through carelessness or misconduct. We may remove a student who breaches these rules, harasses others or endangers safety, and no refund is due in that case.

• Attendance and effort. Results depend on your attendance, practice and effort. We do not guarantee employment, income, certification by third parties or any outcome from completing a course.

• Certificates. We issue a Kobbware certificate to students who complete the course and meet its assessment standards. Certificates may be verified by third parties.

• Materials. Course materials, videos, slides, exercises and software we provide are for your own learning only. You must not copy, share, record, sell or publish them without our written permission.

• Photos and recordings. With your consent, we may take photos or recordings of classes for teaching and promotion. You can withdraw consent for future use by telling us in writing.

• Changes. We may change instructors, schedules, venues or the format (for example, in-person or online) where reasonably necessary, and will tell you as soon as possible.

8. Third-Party Products, Brands and Services

We sell products made by other companies, such as HP, Dell, Lenovo, Apple, Samsung and others. Brand names and logos belong to their owners, and their use here does not mean those companies endorse us unless we say so. Manufacturers’ own warranties and terms apply in addition to ours. We are not responsible for third-party websites, couriers or payment services, though we choose partners carefully.

9. Intellectual Property

All content on our website and in our training, including text, graphics, logos, course materials, videos and software we create, belongs to Kobbware or our licensors and is protected by the Copyright Act 2022 and other intellectual property laws. You may view and print pages for personal, non-commercial use. Any other use needs our written permission. You keep ownership of your own files and data. You give us the limited permission needed to work on them to provide the Services.

10. Warranties and Our Responsibility to You

• We promise that Products will be of merchantable quality, fit for their purpose and as we described them, and that Services will be performed with reasonable skill and care. These promises are in addition to those in the Refund, Return and Warranty Policy.

• Except as stated in these Terms and the Policy, and to the fullest extent the law allows, we give no other warranties, conditions or promises, express or implied.

• Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded, including rights you have under the Federal Competition and Consumer Protection Act 2018.

11. Limitation of Liability

Subject to section 10, and to the extent the law allows:

• we are not liable for indirect or consequential loss, or for loss of profit, revenue, business, goodwill, opportunity or anticipated savings, whether arising in contract, tort (including negligence) or otherwise;

• we are not liable for loss or corruption of data, except where caused by our negligence, in which case our liability is limited as stated below;

• we are not liable for failure or delay caused by events outside our reasonable control (see section 14); and

• our total liability to you for any claim connected to a Product, Service or Academy course is limited to the amount you paid us for that Product, Service or course.

This section applies to businesses and consumers alike, but for consumers it applies only so far as the law allows.

12. Your Responsibility to Us

You agree to compensate us for loss, damage, claims and reasonable costs (including legal fees) that we suffer because you breached these Terms, supplied a Device you had no right to give us, supplied unlawful content or software, or used our Products or Services unlawfully. This does not apply where our own negligence or breach caused the loss.

13. Privacy and Data Protection

We process personal data in accordance with the Nigeria Data Protection Act 2023 and other applicable data laws, as explained in our Privacy Policy. By using our Services you confirm that you have read it. If you give us personal data about other people (for example, files on a device or employee details), you confirm you are entitled to do so.

14. Events Outside Our Control

We are not liable for delay or failure to perform our obligations because of events beyond our reasonable control. These include natural disasters, extended power or network outages, fuel shortages, strikes, civil unrest, government action, import or customs delays, currency restrictions, major supplier failure, internet or cyber attacks, and carrier delays. We will tell you promptly and do what is reasonable to minimise the impact. If the event lasts more than 30 days, either of us may cancel the affected order, and we will refund what you paid for anything we did not deliver.

15. Anti-Fraud and Anti-Money Laundering

We comply with Nigerian laws on fraud and money laundering, including the Money Laundering (Prevention and Prohibition) Act 2022. We may ask for identification or information about payments, delay or refuse orders that appear suspicious, and report suspicious activity to the authorities. We may cancel orders where payment cannot be verified.

16. Trade Compliance for Products and International Customers

By ordering from us, you confirm that you will not use, sell, transfer or export any Product in breach of the laws of Nigeria or of any other country, including applicable sanctions and export control rules (for example, those of the United Nations, the United States, the United Kingdom and the European Union), or for unlawful purposes. We may refuse or cancel any order where we believe that compliance requires it. Customers outside Nigeria remain entitled to the mandatory consumer protections of their home country where those apply.

17. Suspension and Termination

We may suspend or end your access to our website, or refuse or stop a Service, where you breach these Terms, behave abusively towards our staff or students, or where we reasonably suspect fraud or illegality. You may stop using our website at any time. Cancelling does not affect rights and obligations that have already arisen, such as payment for work already done.

18. Communications

You agree that we may contact you electronically, by email, SMS, phone or WhatsApp, about your orders, repairs and classes. Marketing messages are sent only as set out in our Privacy Policy, and you can opt out at any time. Electronic records and messages are valid evidence of our dealings under the Evidence Act 2011.

19. Complaints and Dispute Resolution

1. Tell us first. Contact support@kobbware.com or +234 703 586 0857 with your details and a description of the problem. We will acknowledge within 2 business days and respond substantively within 7 business days.

2. Negotiation. The parties will try in good faith to settle any dispute within 30 days of written notice of it.

3. Mediation. If the dispute is not settled, the parties will try to settle it by mediation, for example through the Lagos Multi-Door Courthouse, before starting any court or arbitration case.

4. Arbitration for business customers. Any dispute with a business customer that is not settled by mediation will be finally decided by arbitration in Lagos under the Arbitration and Mediation Act 2023, before a single arbitrator, in English.

5. Courts. For consumers, and for any matter that cannot be arbitrated, the courts of Lagos State, Nigeria, have jurisdiction.

Nothing in this section stops a consumer from complaining to the Federal Competition and Consumer Protection Commission (FCCPC), the Lagos State Consumer Protection Agency, or any other regulator, or from going to court where the law gives that right.

20. Governing Law

These Terms and any Contract are governed by the laws of the Federal Republic of Nigeria and, where relevant, the laws of Lagos State. If you are a consumer in another country, you also keep the mandatory protections of the law of the country where you live.

21. General Terms

• Entire agreement. These Terms, the Privacy Policy, the Refund, Return and Warranty Policy, and any quote, invoice or order confirmation are the whole agreement between us on their subject. If they conflict, a signed quote or written agreement for a specific job takes priority for that job.

• Changes. We may update these Terms from time to time. The version in force when you place your order or begin your Service applies to it. For continuing use of the website, changes take effect when posted.

• Severability. If any part of these Terms is found unlawful or unenforceable, the rest stays in force.

• No waiver. If we do not enforce a right straight away, we do not lose it.

• Assignment. You may not transfer your rights or duties under a Contract without our written consent. We may transfer ours to a successor of our business.

• No third-party rights. Only you and we can enforce these Terms.

• Language. These Terms are written in English, which prevails over any translation.
